John Elton Bailey has been identified as Kahleb Collins’ grandfather to WBRC 6 News by two family members. Court records filed late Tuesday night confirm the relationship between Bailey and Collins.

A Fayette County grand jury on April 15 issued the indictments against Wendy “Pam” Bailey, 23, and Bailey’s father, John Elton Bailey, 55. The indictments were made public this week.

The children's grandfather John Elton Bailey is also under arrest on a charge of failing to report Kahleb missing, the sheriff’s office previously told PEOPLE.

A jail spokesperson told USA TODAY John Elton Bailey is set to appear in court on Jan. 8. It was not immediately known whether he had obtained an attorney.
